根據警方資料顯示，這起案件發生於16日晚間9時許，22歲姚姓華女行經41路介於緬街和大學點大道附近時，不慎碰撞到喝醉酒的嫌犯克魯斯，兩人隨即引發口角爭執。隨後口角越演越烈，克魯斯突然失去理智，拉著姚女的衣物拖至41路裡，雖然姚女極力掙扎，但身形瘦小的她仍不敵克魯斯的粗蠻拖扯。克魯斯獸性大發，將姚女拉到130多號民宅的停車道牆角，強行脫去姚女下半身衣物強暴，由於姚女奮力抵抗，克魯斯憤而順手拿起一隻鐵棍，朝姚女頭部不斷重擊，姚女險遭活生生打死。
民宅的華裔男屋主聽到女子慘叫聲後立即報警並外出查看，見到這名歹徒畏罪向西朝福樂坊（Frame Place）逃逸，並與趕到現場警員在附近搜索男子蹤跡。
根據一名趕到事發現場的華裔警員描述，姚女下半身赤裸地橫躺在黑暗角落，鮮血不斷從頭部後方冒出，姚女被抬上救護車時，嘴巴仍微微顫動，似乎還想呼救。姚女目前仍在紐約醫院皇后醫療中心（NYHQ）急救，性命垂危。
克魯斯於9時30分在緬街與三福大道附近被警方發現，經目擊者指證後遭逮捕，手上還拿著凶器鐵棍。根據警方表示，當時克魯斯喝得太醉，被警員拖到警察局內，但隨即又被帶到醫院清胃，直到17日早晨7時許才被帶回警局偵訊。據了解，在面對警方詢問時，克魯斯顯得十分害怕，雖然他對罪行沒有正面承認，不過罪證確鑿，警方隨後依謀殺罪第二級、攻擊、強姦、綁架、非法持械、竄改證據（Tampering with Physical Evidence）等罪嫌將其移送法辦。
